Privacy policy
Protecting your privacy is very important to JKTech Pty Ltd (“JKTech”) and we are committed to complying with the Australian Privacy Principles (“APPs”) of the Privacy Act 1998 (Cwth). The APP's identify various standards, rights and obligations relating to the collection, use and disclosure of personal information. To comply with our obligations under the APPs, we have developed a Privacy Policy to set out how we will manage privacy obligations and expectations in our organisation. All management, employees, contractors, sub-contractors, vendors, service providers, customers, agents or any other third parties that have access to and/or utilise personal information collected and/or held by JKTech must abide by this Privacy Policy.
What types of information does JKTech collect about me? JKTech only collects personal information that is reasonably necessary for the purpose of conducting our business. This will vary from one situation to the next, but typical examples of personal information we collect may include an individual’s business contact details, or personal details included as part of an application for employment. JKTech will only use personal information for the purpose for which it was originally obtained. Unsolicited information From time to time, JKTech may receive unsolicited personal information. JKTech will determine if the personal information, if it were solicited, would be reasonably necessary for, or directly related to JKTech’s functions or activities. Where it is not, JKTech will destroy or de-identify the information, unless it is unlawful or unreasonable to do so.
The purposes for which JKTech collects, holds, uses and discloses personal information JKTech will only use or disclose information for the purpose for which it was collected unless the person has consented, or the secondary purpose is related to the primary purpose and a person would reasonably expect such use or disclosure, or the use is for direct marketing in specified circumstances and with the permission of the person, or in circumstances related to regulatory requirements, public interest such as law enforcement and public or individual health and safety. Sensitive personal information Some types of personal information are considered to be more private than others (which, depending on jurisdiction, includes information about someone’s racial or ethnic origin, political opinions, religious beliefs or affiliations, health or medical conditions, genetic information, biometric information, sexual orientation, criminal record, trade-union membership and political association membership). This type of information is called “sensitive personal information”. Sometimes we may collect sensitive personal information about you (such as health or medical information, criminal history checks, or your racial or ethnic origin), but we will only use this information as described above.
How does JKTech store your personal information? JKTech uses reasonable and appropriate means to ensure that any personal information that you provide to us is securely held, used appropriately and protected against misuse, interference, loss, unauthorised access, destruction, modifications or disclosure. We take reasonable steps to hold personal information securely in electronic or physical form. When no longer required, personal information is destroyed in a secure manner or deleted. We also take steps to ensure that the personal information we collect is accurate, up-to-date and complete. These steps include maintaining and updating personal information when we are advised by individuals that their personal information has changed.
How can I gain access to my personal information? You can gain access to your personal information that JKTech holds by sending a request free of charge to JKTech’s Privacy Officer.
Does JKTech share my personal information with overseas entities? Because JKTech operates globally we may share the personal information you submit to us with any entity within the JKTech corporate group, as well as with external service providers that assist us in our business. These entities are required to maintain the confidentiality of this information and are restricted from using it otherwise than in accordance with this Privacy Policy. The nature of JKTech’s business means that we act for clients throughout the world, and so it is not always possible to identify the countries in which recipients of your information are likely to be located.
Notification of the collection of personal information We will notify you that we're collecting your personal data, by providing a privacy statement at or before the time we collect personal data from you. Direct Marketing You give your express and informed consent to us using your personal information where that information relates to the provision of services to you or marketing activities to provide you with information and to tell you about our products, services or events or any other direct marketing activity (including third party products, services, and events) which we consider may be of interest to you, whether by post, email, SMS, messaging applications and telephone. You can opt out of receiving such information from us at any time. Please inform us if you do not wish to receive this information from us. Anonymity and pseudonymity You have the right to deal with us anonymously or under a pseudonym unless it is impracticable for us to do so or unless we are required or authorised by law to only deal with identified individuals. How can I update or correct the personal information that JKTech holds about me? You may request rectification of your personal information by sending an email to JKTech’s Privacy Officer. We will respond to a request for access to personal information within a reasonable period after the request is made. If your personal information is corrected that was previously disclosed to another APP entity, and if you request JKTech to notify the other APP entity of the correction, JKTech will take steps (if any) as are reasonable in the circumstances to give that notification unless it is impracticable or unlawful to do so. If JKTech refuses to make the requested correction, JKTech will provide you with a written notice setting out the reasons for refusal. If JKTech refuses to correct your personal information as requested by you, you may request JKTech to associate with the information a statement that the information is inaccurate, out-of-date, incomplete, irrelevant or misleading. JKTech will take such steps as are reasonable in the circumstances to associate the statement in such a way that will make the statement apparent to users of the information. There will be no charge for the making of the request, for correcting the personal information or for associating the statement with the personal information (as the case may be)
How can I complain about how my personal information has been treated? JKTech seeks to resolve grievances at the local level if possible. Complaints should be addressed to the JKTech Privacy Officer. Complaints will be logged on database/grievances register. The Privacy Officer will refer the grievance to the appropriate person and follow it through to a satisfactory resolution. You may also make a complaint to the Office of the Australian Information Commissioner (OAIC) about the handling of your personal information.
